Submarine Pens Limited. (referred to as “Submarine Pens”, “we”, “us”, or “our”) operates  www.submarinepens.com(the “Website”) and sells products through the Website and authorised channels. These Terms & Conditions (“Terms”) govern your use of the Website and any transactions made through it.

1. Scope & Acceptance

By accessing or using the Website, placing orders, or using any service made available via the Website, you accept and agree to be bound by these Terms. If you do not accept these Terms, please do not use the Website. These Terms form a contract between you and Submarine Pens. We may modify these Terms from time to time; the most recent version will be posted on the Website and will apply to future use.

2. Working Hours

Where timelines, response times, or working-day calculations appear in these Terms or in our policies, they are measured in our working hours: Monday to Friday, excluding Saturdays, Sundays, and national/public holidays. Unless stated otherwise, references to “working days” follow this schedule.

3. Website Use & User Eligibility
  • The Website is an e-commerce and information portal. You agree to use it only for lawful purposes and in a way that does not infringe the rights of others or restrict their use.
  • You must be at least 18 years old (or have legal authority to enter into a contract) to create an account and place orders. By using the Website you confirm you meet this eligibility requirement.
4. Account Registration & Security
  • To place orders or use certain features you may need to register and provide accurate, complete, and current information (“Registration Data”). You agree to keep Registration Data up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account. Notify us immediately (online@submarinepens.co.in) if you suspect unauthorised access. We may suspend or terminate accounts that appear fraudulent or breach these Terms.
5. Products, Pricing & Product Information
  • Product listings on the Website are an invitation to offer. Your order constitutes an offer to purchase. We reserve the right to accept or refuse orders at our discretion. Acceptance is typically completed by dispatch of the product.
  • We aim to provide accurate product descriptions and images. Slight variations (colour, finish, size) may occur due to photography or manufacturing tolerances.
  • Prices shown on the Website are in the currency indicated and exclude applicable taxes, shipping and other fees unless stated. We reserve the right to correct pricing errors and to cancel or refuse orders where pricing or product information is inaccurate. If payment has been taken and we cancel the order, we will refund the amount charged.
6. Order Confirmation, Acceptance & Dispatch
  • After you place an order, we will send an order acknowledgement email confirming receipt. This acknowledgement does not mean your order has been accepted.
  • Your order is accepted when we dispatch the goods to you or notify you that the goods are available for delivery/collection. We may require additional verification or information prior to acceptance.
7. Payment & Fraud Prevention
  • Payments are processed through authorised payment service providers. We do not store full payment card details on our systems. You agree to provide accurate payment information and to pay all charges incurred in connection with an order.
  • We may carry out fraud checks and call for additional verification. If payment is declined or flagged for fraud, we may cancel the order.
8. Cancellation by Submarine Pens
  • We reserve the right to cancel any order at any time for reasons including but not limited to: stock unavailability, pricing or product information errors, suspected fraud, inability to obtain authorisation for payment, or violation of these Terms.
  • If we cancel an order after payment has been processed, we will refund the amount charged to the original payment method within a reasonable timeframe.
9. Cancellation by You
  • You may request cancellation of an order before it is dispatched. If the order has not been processed for dispatch we will cancel and refund the full amount.
  • If you request cancellation after the order has been processed or dispatched, cancellation may be treated as a return and cancellation charges may apply (as per our Returns & Refund Policy). Where applicable, a cancellation fee of up to 5% of the order value or other refund terms will apply as published on the Website.
10. Shipping, Delivery & Risk
  • Shipping, delivery timelines, courier partners and customer responsibilities are governed by our Shipping & Delivery Policy, which forms part of these Terms. Title and risk in the goods pass to you in accordance with that policy.
11. Returns, Exchanges, Refunds & Warranty
  • Returns, exchanges, refunds and warranties are governed by our Return, Replacement & Refund Policy and Exchange Policy, which form part of these Terms. Please read them carefully for timelines, evidence requirements and processes.
12. Third-Party Sellers & Marketplace Items
  • Some products on the Website may be sold by third-party sellers (“Vendors”). When purchasing from a Vendor, the contract is between you and the Vendor; however, Submarine Pens may facilitate the transaction, payment processing and support.
  • We are not responsible for Vendor conduct, and Vendor products may have different return or warranty terms. We do not endorse or guarantee third-party products beyond any express representations made on the product page. Contact details and additional vendor terms (if any) will be provided at the point of sale.
13. Intellectual Property
  • All content on the Website (text, images, logos, product designs, site design, code) is owned or licensed by Submarine Pens and protected by copyright, trademark and other laws. You may use the Website content only for personal, non-commercial use.
  • You agree not to copy, reproduce, modify, publish, transmit, distribute, display or sell any such content without our prior written permission.
14. User Content & Feedback
  • If you post reviews, photos or other content, you grant Submarine Pens a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, modify and display that content in connection with the Website and our marketing. Do not post content that is offensive, infringing, or illegal. We may remove user content at our discretion.
15. Limitation of Liability & Indemnity
  • To the maximum extent permitted by law, Submarine Pens and its affiliates will not be liable for indirect, incidental, special or consequential losses (including lost profits, loss of data or business interruption) arising from use of the Website or purchase of products. Our aggregate liability for direct losses arising from a product will be limited to the purchase price paid for that product.
  • You agree to indemnify and hold Submarine Pens harmless from any claims, losses, liabilities, costs and expenses (including legal fees) arising out of your breach of these Terms, misuse of the Website, or violation of law.
16. Product Availability & Substitutions
  • Products may be subject to availability. If an ordered product is unavailable, we may offer a similar substitute, notify you and seek your instructions, or cancel the order and refund payment.
17. Promotions, Coupons & Loyalty
  • Promotional offers, discount codes and loyalty programmes are subject to specific terms that may be displayed with the promotion. We reserve the right to revoke or refuse any promotion in case of suspected abuse, error or fraud.
18. Force Majeure
  • We are not liable for delay or failure to perform obligations caused by events beyond our reasonable control (natural disaster, strike, pandemic, government action, supply interruption, courier failure, etc.). Where force majeure affects your order we will notify you and take reasonable steps to resolve the situation.
19. Privacy & Data Protection
  • Our Privacy Policy describes how we collect, use and protect personal data. By using the Website you consent to the collection, use and transfer of your information as described in that policy.
20. Termination & Suspension
  • We may suspend or terminate your access to the Website, without notice, for behaviour that breaches these Terms, is illegal or harmful, or for security reasons. Termination does not affect accrued rights or obligations.
21. Notices
  • Notices to you will be sent to the email address you provide; notices to Submarine Pens should be sent to online@submarinepens.co.in. Electronic notices are effective when sent.
22. Governing Law & Dispute Resolution
  • These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms will, to the extent possible, be referred first to informal negotiation and internal escalation. If unresolved, disputes will be subject to the jurisdiction of courts in Mumbai, India (unless otherwise agreed in writing).
23. Severability & Entire Agreement
  • If any provision of these Terms is found invalid or unenforceable, that provision will be severed without affecting the validity of the remaining provisions. These Terms and incorporated policies constitute the entire agreement between you and Submarine Pens regarding the Website and supersede earlier agreements.
